General Terms and Conditions of Sale

Article 1 — Purpose
These general terms and conditions of sale govern the contractual relationship between Oueds & Rios SCOP SARL (hereinafter "the service provider") and any natural or legal person (hereinafter "the client" or "the beneficiary") wishing to book a service offered by the service provider.
Article 2 — Booking
Any booking implies full and unconditional acceptance of these general terms and conditions of sale. The booking is confirmed upon receipt of the deposit payment (see article 3.2).
Article 3 — Pricing and payment terms
3.1 Pricing
Prices in force are those displayed at the time of booking.
For guided activities, prices include:
- Supervision by a state-certified instructor
- Loan of technical equipment (buoyancy aid, helmet, paddle, fins, watercraft and thermal protection, depending on the activity and conditions)
- Personal accident insurance for the participant
For Stand Up Paddle rental, prices include:
- The Stand Up Paddle board
- The paddle
- The buoyancy aid
- Personal accident insurance for the participant
Not included in prices:
- Transport to the meeting point
- Shuttles for river activities (complimentary)
- Photos and videos (optional)
- Other consumables (drinks, merchandise, etc.)
3.2 Payment terms
For guided activities, payment is made in two stages:
- Deposit payment at the time of booking
- Balance due on the day, at the start of the session
For Stand Up Paddle rental, payment is made in one stage:
- Online, at the time of booking
- On-site, on the day, at the start of the session
Accepted payment methods:
- Cash,
- Service provider gift voucher,
- Bank card (online only),
- SEPA bank transfer,
- French bank cheque,
- ANCV holiday vouchers (paper only),
- ANCV sport coupons (paper only),
- Pass Sud Montagne (PACA Region).
3.3 Late payment
Any delay in paying the balance will result in the impossibility of participating in the activity, with no refund of the deposit paid.
Article 4 — Cancellation and modification
4.1 Cancellation by the client
In the event of cancellation by the client, regardless of the notice period and the reason, the deposit paid remains the property of the service provider and will not be refunded.
In accordance with article 1590 of the French Civil Code, the deposit constitutes a fixed-sum compensation for the company.
4.2 Cancellation by the service provider
In the event of cancellation due to practical, technical or safety reasons, or due to insufficient numbers of participants, clients will be offered priority rescheduling to a later date (deposits paid are transferred to the new booking).
If no alternative date suits the client, the deposit will be refunded in full.
The service provider cannot be held responsible for any ancillary costs incurred by participants (transport, accommodation, meals).
4.3 Modification
Any request to modify a booking (date, activity, number of participants) must be made by phone on +33 (0)6 12 51 21 42 at least 48 hours before the scheduled date.
The modification remains subject to acceptance depending on availability. Deposits paid may be transferred to the new booking if the modification is accepted.
Within 48 hours of the session, transfer of the deposit remains possible at the sole discretion of the service provider.
Article 5 — Gift vouchers
5.1 Nature and use
Gift vouchers issued by the service provider are a means of payment usable for any service (guided or rental) offered by the service provider, up to their remaining balance and within their validity period. The balance is initialised at the time the voucher is created, then debited with each payment. They can be used online on the service provider's e-commerce sites, in quote-based sales and at the point of sale. They are non-nominative: it is the unique code on the voucher that grants access to the benefit.
5.2 Validity
Gift vouchers sold on the service provider's e-commerce sites are valid until 31 December of the year following the purchase date (31/12/N+1), unless otherwise stated.
5.3 Non-refundability
Gift vouchers cannot be refunded by any means of payment. They do not give rise to any change being given, as only the value of the order is debited from the voucher balance. As long as the balance is not zero, the voucher can be reused within its validity period.
5.4 Cancellation
The cancellation conditions of article 4 of these terms and conditions apply normally.
Article 6 — Physical and medical conditions
Whitewater activities require a good general level of physical fitness and the ability to swim 25 metres and submerge.
The following contraindications make participation impossible or subject to prior medical advice:
- Joint fragility: ankles, knees, hips, spine, shoulders, elbows, wrists
- Cardiovascular or respiratory conditions or risk factors
- Diabetes or any other condition that may affect participation
The client undertakes to communicate any relevant medical information to the service provider as soon as possible so that the guide can be informed.
Article 7 — Liability
The activities offered by the service provider are supervised by state-certified professionals. The service provider is responsible for the safety of participants within the scope of the services offered. Participants are required to follow the safety instructions given by the guide.
Article 8 — Insurance
The service provider holds professional civil liability insurance. Participants are covered by personal accident insurance included in the price of the service.
Participants are advised to take out cancellation insurance to cover costs in the event of unforeseen circumstances.
Article 9 — Personal data protection
Personal data collected at the time of booking is used solely for the purposes of managing bookings, individual insurance and client relations. In accordance with the GDPR, you have the right to access, rectify and delete your data by contacting contact@ouedsrios.com.
Article 10 — Applicable law and jurisdiction
These general terms and conditions of sale are governed by French law. Any dispute shall be referred to the courts with jurisdiction over the registered office of the service provider.
Article 11 — Complaints and mediation
Any complaint must be sent by email within 15 days of the service to: contact@ouedsrios.com.
